Protect Your Future by Fighting Your Sex Crime Charge

Failure to Register as a Sex Offender

Los Angeles Sex Crime Lawyer

The state of California requires most convicted sex offenders, as well as some individuals convicted of certain consensual or non-sexual offenses – to register as a sex offender. The sex offender registry displays all personal information of convicted offenders to the public, and enables law enforcement officials to track their personal lives. Because sex offender registration is viewed as a crucial tool in protecting public safety, failing to register is considered a serious offense.

Sex offender registration can be a profound and long-term consequence of sex crime convictions. Convictions considered registerable offenses under California include, among others:

  • Sex crimes involving children
  • Child pornography
  • Internet sex crimes, including online solicitation
  • Some kidnapping offenses
  • Human trafficking

Penalties for Failing to Register as a Sex Offender

While registration as a sex offender is a serious burden in and of itself, failing to register is a separate crime that poses harsh penalties. In addition to registering after a conviction, convicted offenders in California must renew registration:

  • Every year; or
  • Every time a change of residence occurs.

Under California Penal Code 290, failing to register is penalized differently depending on the crime for which an individual was convicted:

  • Misdemeanor – If the sex crime conviction was a misdemeanor, failing to register may result in up to one year in jail.
  • Felony – If the conviction was for a felony sex crime or if it is a multiple offense for failing to register, you may face up to three years in prison.
